Serveasy Terms of Service

Please read these Terms of Service ("Terms") carefully before using Serveasy (the "Service") operated by Serveasy ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
1. Description of Service
Serveasy is a software tool designed to help businesses manage their operations, bookings, staff, and customer interactions. Serveasy is provided as a tool only and does not guarantee any particular business outcomes, revenue, bookings, or results.
You acknowledge that the success of your business depends on many factors outside the scope of the Service, and that Serveasy bears no responsibility for your business performance.
2. Accounts
When you create an account with us, you must provide accurate, complete, and up-to-date information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
3. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Upload, transmit, or store any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Impersonate any person or entity or misrepresent your affiliation
- Attempt to gain unauthorised access to the Service, other accounts, or any related systems
- Scrape, crawl, or use automated means to access the Service without our written permission
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Use the Service to send spam or unsolicited communications
- Input personal data of third parties (including customers or staff) without having a lawful basis to do so
4. Use of Service
Staff Management
When adding staff members to the system, you confirm that:
- You have obtained consent from staff members to add their information
- Staff contact details are accurate and up-to-date
- You will promptly update or remove staff information when requested
- You will only use staff information for booking management purposes
Booking Terms
When using the booking system, you acknowledge that:
- Staff assignments are subject to availability
- Booking confirmations are dependent on staff acceptance
- Location data may be collected for service delivery purposes
- Cancellation policies are set by individual businesses
- The system may automatically update booking statuses based on time
Beta Features
Some features of the Service may be marked as "Beta". Beta features are provided for testing and evaluation purposes and are subject to the following conditions:
- Beta features are provided "as is" and may contain bugs or errors
- Access to beta features is temporary and may be revoked at any time
- Beta features may become paid features once they exit beta status
- We will provide at least 30 days' notice before transitioning a beta feature to paid status
- You are not obligated to continue using or paying for features that transition from beta to paid status
By using beta features, you acknowledge and agree to these conditions. We reserve the right to modify, charge for, or discontinue any beta feature at our discretion.
5. Your Data and Responsibilities
You are responsible for the content and data you provide through the Service, including business information, staff details, and customer data. You retain all rights to your content, but grant us a non-exclusive, worldwide licence to use, process, and display it as necessary to provide the Service.
Where you use Serveasy to process personal data of your customers or staff, you are the data controller for that data and we act as your data processor. You are responsible for:
- Ensuring you have a lawful basis to collect and process that data
- Providing appropriate privacy notices to your customers and staff
- Responding to data subject requests from your customers and staff
- Complying with all applicable data protection laws
We will process such data only in accordance with your instructions (as given through use of the Service) and our Privacy Policy.
6. Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Serveasy. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
7. Availability and Uptime
We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control. We will make reasonable efforts to notify users in advance of planned downtime where possible.
8. Disclaimer of Warranties and Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service. You expressly agree that your use of the Service is at your sole risk.
To the full extent permissible by applicable law, Serveasy disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Serveasy does not warrant that the Service, its servers, or email sent from Serveasy are free of viruses or other harmful components.
To the maximum extent permitted by law, Serveasy's total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the total amount of fees paid by you to Serveasy in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty pounds (£50), whichever is greater.
In no event shall Serveasy be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, goodwill, or revenue, whether or not we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless Serveasy and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any applicable law or regulation; (d) any data you input into the Service, including customer and staff data; or (e) any claim by a third party (including your customers, staff, or end-users) arising from your use of the Service.
10. Termination
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms, engage in fraudulent or illegal activity, or use the Service in a manner that could harm other users or the Service itself.
For terminations not related to a breach of these Terms, we will provide at least 14 days' notice where reasonably practicable.
Upon termination, your right to use the Service will immediately cease. You may request a copy of your data within 30 days of termination, after which we may delete it.

11. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, cyberattacks, pandemics, or the acts or omissions of third-party service providers.
12. Dispute Resolution
If you have a dispute with us, we encourage you to first contact us at seb@serveasyapp.com so we can try to resolve the matter informally.
If a dispute cannot be resolved informally within 30 days, either party may pursue resolution through the courts of England and Wales.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
